TERMS AND CONDITIONS FOR ONLINE ORDERS
The following Terms And Conditions govern the offer and sale of products from Albina Dyla, a company with unique identification number 811144328, with business registration number 71088316, with VAT Certificate number 330242264 and with fiscal number 601154214, registered near the Ministry of Trade and Industry in Prishtina, with premises in Skenderbeu Street n.n, Gjakova 50000, Republic of Kosovo.
These General Terms And Conditions are applicable to all of the purchases of items concluded by our WebSite-ALBINADYLA. ( www.albinadyla.com)
1. Business policy
1.1. The items are intended to be sold to legal persons, who are purchasing upon personal needs ( hereinafter referred to as the “Customer”).
1.2. The Customer, therefore, agrees to act as a Customer and not purchase with the intentions of using the items for commercial purposes such as reselling, putting the items up for rent, etc.
1.3 Defects for which the seller is not responsible.
1.3.1 The seller is not liable for the defects, if the buyer at the time of entering into the contract was aware of the defects, or they could not have been unknown to him.
1.3.2 It is considered that they may not be unfamiliar to the buyer, those flaws which a careful person, with average knowledge and experience of the person of the same craftsmanship and profession as the buyer could easily notice during ordinary viewing of the item.
2. Modifications of Terms and Conditions
2.1. Albina Dyla reserves the right to make changes to The Terms and Conditions.
2.2. The Customer will be notified of any relevant changes up to 4 weeks before changes will take place.
3. Ordering Process
3.1. To place an order, the Customer must contact or has to be contacted by one of our official communication channels:
3.1.1 Our Website – ALBINA DYLA ( www.albinadyla.com)
4.1. To place an order/purchase an item, the Customer must pay the full price of a product.
4.2 The payment(s) must be done through VISA, VISA ELECTRONIC, OR MASTERCARD.
5.1. Albina Dyla offers three types of products:
a) Ready-made products (Products that are ready to buy from the customers, that are produced mainly in 36, 38, or 40 size);
b) Pre-made products (Products that customer can order according to their sizes, but they don’t want to make any extra requirements in the product);
c) Customized products (Products that can be made by the Client’s requests and measurements)
5.2. If the Customer purchases a ready-made product, he/she will receive the same product as seen on Albina Dyla’s official social website;
5.2.1. The Customer understands that there may be slight differences in color, due to the different color settings in different monitors/screens.
5.3. If the ordered product is handmade, or contains handwork, the Customer understands that the product cannot be recreated in a completely identical way, as it’s done by hand and not by machine.
The product will be done approximately 90-95% the same if the beading and material used is the same as the promoted product.
5.4. Albina Dyla products take 2-30 days to be produced, depending on the complexity of the product. The sales team will accommodate a delivery date for the Customer as a deadline.
5.4.1. Exceptions to the timeframe defined in Article 5.3. are the cases where the material is not in stock and it has yet to arrive, and/or unpredicted circumstances, which the Customer will be informed about.
6. Shipping policy
6.1. The shipping costs will be covered by Albina Dyla. Note that this excludes customs’ fees (please refer to Article 7. Customs) and VAT.
6.2. Albina Dyla offers worldwide shipping. The courier companies used for shipping are depending on your location:
6.3. The products can only start shipping during weekdays.
6.4. The product(s) take(s) 7-15 business days to arrive at the Customer’s delivery address (not including your customs process that might take).
6.4.1. The express posts typically write the estimated delivery date a few days later than the actual delivery date in case of emergencies, which means that the product will arrive earlier and that the Customer shouldn’t be alarmed.
6.5. The Customer can choose between giving Albina Dyla agents a delivery address, or pick up the product at his/her local Office.
Once the product is delivered, the Customer is required to sign the package. If the package is not signed/nobody is home, courier posts will attempt to deliver the package a few more times and get in contact with the Customer.
7.1 Upon arrival in the destination country or area, the contents of your order may be subject to customs fees (taxes, duties, processing fees, brokerage fees, etc.) for which the recipient of the order is responsible. We are not responsible for any customs fees incurred on your order.
7.2 Should you refuse your order at the time of arrival or should you refuse to pay the Customs fees when your order arrives, the shipment will be returned to the Vendor and we will be charged the Customs fees plus return shipping costs. If you receive your order and
accept to pay the Customs fees upon delivery, the Vendor will not issue refunds for the same in case of return of the purchased products.
7.3 Customs processing may delay the delivery of your order. Should you experience such delays please check with your local Customs offices. The invoice for the Customs fees could arrive weeks after you receive your order, separately from the same.
7.4 However, Albina Dyla wants to serve the customers in the best way possible, therefore
Albina Dyla has compiled a few methods to help the Customers with covering the customs’
7.4.1. The customer understands that the help for the customs does not indicate help in regards to other charges, or VAT.
7.4.2. If the Customer’s delivery address is in the European Union, the customer must be informed of the SAA Agreement.
This agreement between Kosovo and European Union states suggests that each product that is produced and exported from Kosovo to a European Union state is free from customs charge.

7.4.3. The Customer understands that Albina Dyla does not guarantee that this agreement will be followed by the Customer’s state customs, although they are obliged to.
7.4.4 If the Customer’s delivery address isn’t in the European Union, the Customer must consult with an Albina Dyla agent in regards to which category his/her country belongs to.
7.4.5. If the Customer’s country is in the DDP (Delivery Duty Paid) category, Albina Dyla will be covering the customs’ cost.

8. Return/ Exchange policy
8.1 If you want to return the product purchased from our Company, you have 24 hours from the moment you have received the package, to inform us about it. After we will receive your email we will send you a confirmation (if your request has been approved or not) and we will inform you about the refunding process.
8.2 The Customer has a right to return his/her order if:
● The order is not sewn properly.
● The product has not been made according to the measurements you have sent us
● The order is damaged or not created according to your requirements.
8.3 If the product did not meet your expectations for one reason or another, please carefully follow our guide:
● Contact us within 24 hours after you receive the item.
● Provide us with photos of the dress, to show evidence of damage or bad quality, this also applies for the size, or incorrect style and color, etc.
● The returned item must be in perfect condition (as new), you can try the dress on, but be sure not to stretch it or make any dirty marks, otherwise, we will refuse the return.
We only accept products in their original condition, and we cannot process any products that are returned without our approval.
● Items must be returned in 7-15 days upon delivery date.
● We will arrange the return shipment pick up with one of the express worldwide posts. Please verify that you have accurately completed and included with your parcel all the necessary documentation for Customs clearance.
8.4 If the return right is exercised in conformity with the provisions set forth in this section, we shall refund the amount paid for the returned products. Any duties, taxes, and fees you have paid for the delivery of the purchased products shall not be refunded. You will be notified via email if the returned products cannot be accepted. In this case, you may choose to have the products delivered to you at no expense to the Vendor. If you refuse
the above delivery, the Vendor reserves the right to retain the products and the amount paid for your purchase of the products.
8.5 Whatever payment type you used, the refund procedure shall be started by the Vendor within thirty (30) days from when the Vendor was informed of your decision to exercise your return right and after checking that the return right has been correctly exercised and that the returned products have been accepted.
9. Cancel/Refund Policy
9.1. The Customer is eligible to cancel his/her order.
9.2 Please read the below instructions according to the refund policies separated by the moment or time when you want to cancel the order:
9.2.1 Order canceled within 24 hours of payment confirmation will be eligible for a full refund.
9.2.2 Cancellation within 24 to 72 hours after the order is paid: you will get a partial refund consisting of 50% of the item price.
9.2.3 Cancellation within 72 to 120 hours after the order is paid: you will get a partial refund consisting of 30% of the item price.
9.2.4 Cancellation beyond 120 hours after the order is paid: you will not expect any refund at all.
9.3 The use of the same amount of payment for your next order it’s not acceptable, you will lose the previous one and you need to send the new payment for the next order.
10.1. The Customer understands that the Customer’s full name, e-mail address, phone number, and delivery address are information that must be collected from Albina Dyla.
The full name is used when referencing the order.
The e-mail address is used to send the Customer any relevant document and/or information about the Customer’s order, and/or anything else Albina Dyla may deem as important.
The phone number is used as contact information in the shipping package.
The delivery address is used as the product’s destination address when shipped.
10.2. The Customer understands that this information is collected in Albina Dyla’s online orders database, to keep a record of the information so it isn’t lost.
10.3. The Customer understands that the Customer’s personal information will be used solely for the purposes stated in Article 10.1., and his/her information will not be published, shared, or distributed in any way, shape or form.
10.3.1. In the event that the Customer’s photos are posted in our promotion channels, consent will be requested.
11. Intellectual Property Policy
11.1. The Customer shall not reproduce, represent, distribute or adapt, directly or indirectly, any exclusive content pertaining to Albina Dyla including trademarks, illustrations, photographs, videos, and designs in any way, shape, or form, without prior written consent from Albina Dyla.
